Easy Asset Distribution

A “Harta Sepencarian Claim” can be made in court, however very detailed proof of documents (receipts, bills, etc.) would be required as proof of evidence.

If a Harta Sepencarian document is prepared beforehand, this would not be necessary when asserting the claim and will greatly expedite the asset distribution process
Not Contestable

Assets under Harta Sepencarian is not considered as part of the rules of Faraid and is consequently distributed prior to Faraid. Thus, the rights of both spouses are fully protected because what is agreed upon in the agreement is incontestable in court.
Mutual Agreement

Both parties are to outline and decide upon the apportionment of distribution.

Eligibility

Husband and wife/wives must be Muslims & aged 18 years old and above
Legally marriage under Islamic Family Law in Malaysia
Sound mind & at own freewill
Not under any legal prohibition to administer his/her property
The Husband must hold a Comprehensive Wasiat from as-Salihin Trustee Berhad. For more information on Comprehensive Wasiat click here

Key Notes

Harta sepencarian is also known as Jointly Acquired Asset Agreement in English.
This document is an agreement outlining the split of assets jointly acquired by both husband and wife/wives during the period of a valid Islamic marriage.
In the event of a Spouse’s death, the surviving spouse is entitled to claim the portion stipulated in the Harta Sepencarian Agreement.
Claims for Harta Sepencarian can be made at the time of a spouse’s death, after divorce or before the husband enters into a polygamous marriage.
Harta Sepencarian is not a standalone product and must be taken with a Comprehensive Wasiat by AST, with AST appointed as the executor in the Wasiat.

Rancang Harta Sepencarian is a Product Package combining Comprehensive Wasiat and Harta Sepencarian. Comprehensive Wasiat is a precondition to Harta Sepencarian; thus the pricing below applies:
